Terms and Conditions of Printumo.com

These Terms and Conditions govern the use of the Printumo ApS platform ("Platform"), a print-on-demand service that connects merchants ("Customer") with fulfillment partners for the production and shipment of custom products. By using the Platform, the Customer agrees to be bound by these terms.
1. Definitions
1.1. Customer: Refers to any individual or entity using the Platform to order products.
1.2. Platform: Refers to Printumo ApS and its services, including software that allows Customers to place orders with fulfillment partners.
2. VAT and Taxation
2.1. VAT Charge: VAT will be charged based on the Customer’s location unless a valid VAT identification number is provided.
2.2. Destination VAT: VAT will be charged based on the destination country's tax laws when production occurs in the same country as the delivery address.
2.3. VAT Documentation: The Customer is responsible for ensuring that any VAT ID provided is valid and current.
3. Order Processing and Production
3.1. Order Finality: Orders cannot be canceled or modified once sent to production, including changes to shipping addresses.
3.2. Production Timeline: Average production time for orders within EU is 2 days and 1 day within the UK.
3.3. Delivery Timeline: Orders arrive on average 3-5 weekdays after shipment, but delivery times may vary based on the destination.
4. Returns and Cancellations
4.1. No Returns Policy: All products are made to order and cannot be returned once produced.
4.2. Non-Deliverable Items: If an order is returned to the sender due to an incorrect address or refusal by the recipient, the products will be destroyed without refund or replacement.
5. Damaged Goods
5.1. Damage Reporting: The Customer must notify the Platform of any damages within 48 hours of delivery and provide photographic documentation in line with the carrier’s terms.
5.2. Replacement Policy: Valid damage claims will result in a replacement order at no extra cost to the Customer.
5.3. Exclusions: The Platform is not liable for damages resulting from improper handling or delivery failures due to incorrect addresses.
6. Liability and Responsibility
6.1. Invalid Addresses: The Platform is not responsible for lost orders or delays due to incorrect addresses.
6.2. Refused Deliveries: If a recipient refuses delivery or customs duties are denied, no refund or replacement will be provided.
6.3. Customs Duties and Taxes: The Customer is responsible for any customs duties, taxes, or other fees applicable to shipments.
6.4. Limited Liability: The Platform’s liability is limited to the amount paid for the affected order, excluding indirect or consequential damages.
7. Payment and Billing
7.1. Automatic Payment: Orders placed through a connected store will be automatically charged to the credit card on file.
7.2. Failed Payments: Orders will not be processed until valid payment details are provided.
7.3. Pricing: Prices for products and services are subject to change without notice and will not affect orders already in production.
8. Customer Responsibilities
8.1. Accurate Information: The Customer is responsible for ensuring the accuracy of all information provided, including shipping addresses and product specifications.
8.2. Compliance with Laws: The Customer is responsible for complying with all applicable laws related to the sale and distribution of products ordered through the Platform.
9. Acceptable Use
By using the Platform, the Customer agrees to do so in a lawful, ethical, and responsible manner. This includes refraining from uploading or submitting any content that is illegal, abusive, or infringes on the rights of others, such as copyrighted material, hate speech, or explicit content. The Platform reserves the right to remove or suspend access to any content that violates this Acceptable Use Policy.
10. User Content
All content uploaded, created, or submitted to the Platform, including but not limited to artwork, designs, descriptions, and other materials, remains the Customer’s intellectual property. By using the Platform, the Customer grants Printumo ApS a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the content for the operation, promotion, and improvement of the Platform. The Platform will not use the Customer’s content for any other purpose without explicit written consent.
11. Dispute Resolution
9.1. Governing Law: These terms are governed by the laws of Denmark.
9.2. Jurisdiction: Any disputes will be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.
12. Amendments
The Platform reserves the right to amend these terms at any time, with changes posted on the website and applicable to orders placed after the effective date.
